This Terms and Conditions of Service Agreement ("Agreement") constitutes a legally binding contract between The Rising Mind and any individual or entity ("Client," "User," or "you") accessing our website, purchasing our services, or participating in our therapy, sound healing, and mental wellness programs.

By accessing our website or utilizing our services, you acknowledge that you have read, understood, and agreed to be bound by the terms contained herein.

1. Scope of Services

The Rising Mind provides mental health and holistic wellness services, including professional psychotherapy, sound healing modalities, guided mindfulness, and mental peace resources ("Services").

• Psychotherapy Services: Rendered solely by licensed mental health professionals in accordance with applicable clinical standards, local licensing regulations, and professional codes of ethics.

• Complementary Modalities: Sound healing, meditation, and general wellness practices are complementary, non-clinical modalities designed to support stress reduction and personal well-being.

   

2. Clinical & Medical Disclaimer

2.1 Non-Emergency Notice

OUR SERVICES AND WEBSITE ARE NOT INTENDED FOR MEDICAL EMERGENCIES OR CRISIS INTERVENTION. If you are experiencing acute suicidal ideation, self-harm impulses, or a medical emergency, you must immediately call your local emergency services (e.g., 911, 112, 988) or report to the nearest hospital emergency department.

2.2 Distinction of Modalities

Sound healing, vibrational therapy, and general wellness workshops are not forms of medical care, clinical psychiatry, or medical treatment. They are not intended to diagnose, treat, cure, or prevent any physical or mental disorder. Participation in sound healing does not establish a therapist-patient relationship.

2.3 Physical & Auditory Prerequisites

Clients registering for sound healing or group audio-vibrational sessions warrant that they do not suffer from unmanaged medical conditions that could be aggravated by high acoustic frequencies, sound resonance, or rhythmic acoustics (including, but not limited to, auditory-triggered epilepsy, severe tinnitus, unmanaged cardiac conditions, or wearing deep-brain stimulation devices). It is your sole responsibility to consult a physician prior to attendance.

3. Informed Consent & Client Responsibilities

• Truthful Disclosure: You agree to provide accurate, complete, and current information regarding your health history and contact details during intake and booking procedures.

• Voluntary Participation: Engagement in all therapeutic and sound modalities is entirely voluntary. You reserve the right to pause or discontinue participation during any session.

   

4. Confidentiality & Legal Exceptions

Client confidentiality is strictly maintained in accordance with applicable legal and professional standards (such as HIPAA, GDPR, or equivalent local health privacy laws). Personal health information shared during formal therapy will not be disclosed without written consent, except under the following mandatory legal exceptions:

1. Imminent threat of harm to yourself or others.
2. Reasonable suspicion of child, elder, or vulnerable adult abuse or neglect.

3. Express court order or lawful subpoena issued by a court of competent jurisdiction.

    

5. Financial Terms, Bookings, & Cancellations

• Payment: Fees for all therapy sessions, sound healing workshops, and consultation packages must be paid in full at the time of booking or according to the agreed billing cycle.
• Cancellation Policy: Session cancellations or rescheduling requests must be submitted at least [24 / 48 hours] prior to the scheduled start time. Cancellations made with less than the required notice, as well as missed appointments ("no-shows"), will be charged the full session fee.

• Refunds: Payments for completed sessions, sound healing events, or digital wellness products are non-refundable. If The Rising Mind cancels an event or session due to unforeseen provider unavailability, a full refund or session credit will be issued.

   

6. Intellectual Property Rights

All audio recordings, sound healing tracks, written materials, graphics, branding, and proprietary protocols published on or provided through The Rising Mind are the exclusive intellectual property of the Company.

• You are granted a limited, personal, non-transferable, non-exclusive license to use purchased audio/wellness content for personal, non-commercial purposes.

• Re-recording, distributing, broadcasting, commercializing, or modifying any audio or therapeutic assets without explicit prior written authorization is strictly prohibited.

   

7. Limitation of Liability

To the maximum extent permitted by applicable law, The Rising Mind, its directors, licensed clinicians, sound healing practitioners, employees, and independent contractors shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to:

• Your reliance on non-clinical website content or public wellness materials.
• Personal physical discomfort or emotional responses resulting from sound healing or meditation sessions.

• Technical disruptions, platform outages, or unauthorized third-party access to digital transmissions.

   

8. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of [Your State/Country], without giving effect to any principles of conflicts of law.
